Please read these Terms and Conditions carefully before using the Dody Egypt Smart Transport application. By using the app, you agree to be bound by these terms.
1. Terms of Use
By downloading, browsing, accessing, or using the "Dody Egypt Smart Transport" application, the user agrees to comply with all terms and conditions set forth in this document.
The Company reserves the right to modify or update these Terms and Conditions at any time without prior notice. If the user does not agree to any of these terms, they must immediately stop using the application and the services provided through it. Continued use of the application after any modifications are published constitutes explicit acceptance of those modifications.
2. Definitions
Unless the context requires otherwise, the following terms shall have the meanings set out below:
- Company:
- Dody Egypt Smart Transport, a company registered and licensed within the Arab Republic of Egypt, responsible for managing and operating the application and intermediating the services provided through it.
- Application:
- The mobile application that enables connection and coordination between users and service providers.
- Account:
- The electronic account created by the user or service provider after registering in the application.
- Service Providers:
- Individuals or companies registered with the Company to provide approved transport services through the application.
- User:
- Any person who uses the application to benefit from the services available within the Arab Republic of Egypt.
- Services:
- All transport services provided by service providers through the application, which the Company intermediates to make available to users.
2.1 What is the Dody Egypt Smart Transport application?
The Dody Egypt application is a specialized technology platform for connecting users with transport service providers. The Company acts solely as a technical intermediary to facilitate booking, communication, and order management.
The registration and approval of service providers is subject to evaluation and verification procedures in accordance with the laws and regulations governing the Arab Republic of Egypt.
3. Prohibited Materials Policy (Very Important)
Legal Warning
It is strictly prohibited to use the application's services to transport:
- Raw meat.
- Weapons and ammunition.
- Narcotic or prohibited substances.
- Any materials or goods that violate Egyptian laws and regulations.
The Company is fully committed to cooperating with the relevant security and regulatory authorities when illegal activity is suspected. The user or service provider bears full legal and criminal responsibility for any violation of these provisions.
4. Location and Scope
Location
The application's services are limited exclusively to the territory of the Arab Republic of Egypt.
Scope of Use
The application and services are intended for personal use only and may not be used for commercial purposes except with prior written approval from the Company.
5. User Obligations
The user acknowledges and guarantees the following:
- The accuracy and correctness of all data and information provided.
- Not using the application for any unlawful purpose or in violation of applicable regulations and public morals.
- Compliance with all laws and regulations in force in the Arab Republic of Egypt.
- Not misusing the application or attempting to disable, hack, or interfere with its operation.
6. Disclaimer
Dody Egypt Smart Transport acts solely as a technical intermediary between the user and the service provider and does not bear responsibility for any direct or indirect damages that may arise from use of the application or from service outages or delays.
6.1 Unpaid Trips
Fare collection responsibility: The service provider bears full responsibility for collecting the trip fare from the passenger upon completion of the trip.
If the customer refuses to pay the fare in whole or in part, the outstanding amount is recorded as an "unpaid fare" within the application system.
Dody Egypt Smart Transport bears no responsibility for uncollected amounts and is not obligated to compensate service providers for such amounts.
Handling unpaid balances: The service provider may be notified through the application of previous outstanding amounts owed by the customer, which are added to the total amount required to be paid. In this case:
- The service provider is not required to collect previous outstanding amounts from the customer.
- The Company undertakes follow-up and recovery procedures for unpaid amounts.
- If the customer pays the outstanding amount in cash and the service provider accepts it, the service provider agrees to settle this amount with the Company, and it may be deducted from any future entitlements.
7. Indemnification
The user agrees to indemnify Dody Egypt Smart Transport and hold it harmless from any claims, lawsuits, losses, damages, costs, or expenses arising from:
- Their use of the services or application.
- Use of their account or login credentials by any other person.
- Their violation of any provision of these Terms and Conditions.
The user also undertakes to pay all compensation, costs, and legal expenses resulting therefrom.
8. Governing Law and Jurisdiction
These Terms and Conditions are governed by and interpreted in accordance with the laws of the Arab Republic of Egypt.
Egyptian courts alone have jurisdiction to adjudicate any dispute arising from use of the application or from the interpretation or enforcement of these Terms.
9. Application and Service Usage Rules
9.1
The Company makes reasonable efforts to address any errors or malfunctions reported, but does not guarantee that the application or services are entirely free of errors.
9.2 Data Privacy and Secure Communication
To protect users' privacy:
- Phone numbers and personal data are hidden between the customer and the service provider.
- Communication between the parties is limited to official channels available within the application.
- Communication may take place through the Company's customer service when needed without disclosing either party's personal data.
9.3
The Company does not guarantee uninterrupted service or accurate or instant delivery of messages and notifications at all times.
9.4
The Company provides no warranty that the application or services are free of viruses or harmful software.
9.5
The Company reserves the right to modify, update, suspend, or remove any part of the application or services at any time without prior notice.
9.6
The Company may delete, modify, or block any content it deems to violate these Terms or applicable laws.
9.7
A service provider may accept or reject any service request at their discretion. The user may also cancel a request in accordance with the cancellation policy approved by the Company.
Both parties acknowledge that Dody Egypt Smart Transport is not responsible for:
- Delayed or cancelled requests.
- Failure of communication between the user and the service provider.
- Non-performance or delay of the service by the service provider.
10. Suspension and Termination of Service
The Company may suspend or terminate an account or block access to the application in the following cases:
- Violation of any provision of these Terms.
- Suspicion of fraud or misuse.
- Providing misleading or incorrect information.
- Any conduct that harms the Company, users, or service providers.
The Company fully cooperates with the relevant judicial and security authorities upon request.
Termination of the account does not affect any rights, obligations, or claims that arose before the termination date.
